MULTI-EMPLOYER BENEFIT PLANS

 
 

We represent several types of Multi-Employer Taft-Hartley Benefit Plans, including health and welfare, defined contribution and defined benefit plans.  We also represent apprenticeship programs.  We take a pro-active approach to our representation of these funds and bring to the attention of the trustees new ideas and concepts for the trustees to consider.  We take pride in offering a progressive approach to your benefit needs.

Health and Welfare Plans

We can represent health and welfare plans from their formation to termination or merger.  We regularly represent plans with their operations and compliance, including the following:

  • Counseling on plan design and operation
  • Advising on compliance with regulatory requirements, including the Affordable Care Act, and HIPAA Privacy and Security Rule compliance
  • Drafting participant communications, including Summary Plan Descriptions, Summary of Material Modifications, and participant communications
  • Counseling on Department of Labor investigations and Internal Revenue Service audits
  • Counseling regarding litigation and collection of delinquent contributions, including advising on contribution collection procedures, compliance audits, bonding alternatives, mechanics and public liens and ERISA benefit litigation
  • Review and advice on subrogation matters
  • Review of benefit determinations and appeal decisions
  • Issuing request for proposals, reviewing and negotiating provider contracts

DEFINED CONTRIBUTION and 401(k) PLANS

We represent defined contribution and 401(k) plans.  With Multi-Employer Defined Benefit Plans being in questionable status these days, we are seeing the expansion of defined contribution and 401(k) Plans.  If you are looking for legal counsel to discuss setting up or helping with continued operations of a defined contribution and 401(k) plan for you, please contact us.

DEFINED benefit PLANS AND WITHDRAWAL LIABILITY

We represent defined benefit plans with all of their legal needs. We also regularly counsel employers and associations with their questions on withdrawal liability, rehabilitation plans and other questions relating to the funding status of defined benefit plans they participate in.

We provide the following services for these types of plans:
